Call to Order

The regular meeting of the Kiowa Water and Wastewater Authority was called to order on July 11, 2023, at 6:00pm by President Debbie Ullom. Also in attendance: 

Directors: Eric Whitman and Teresa Parker in person, and Tim Craft via zoom. Annette Burmaster was absent. 
Legal Counsel: George Rowley 
Town Clerk/Utility Billing Clerk: Katti Arnold 
Town Administrator: Kimberly Boyd

Consent Items

  1. Approval of Agenda
    Teresa Parker made the motion to approve the agenda. Tim Craft seconded, and the motion passed with no discussion.
  2. Approval of Minutes
    Eric Whitman made the motion to approve the May 9th regular meeting minutes as written. Teresa Parker seconded, and the motion passed with no discussion.

Financial Report

  1. Year to date P&L 
    The financials were reviewed and discussed. 

Staff Reports

  1. Paul Grant, Headways Consultant, LLC
    Paul Grant's monthly report was reviewed and discussed.
    Paul talked about getting the elbow at the sewer plant scheduled with C&C to be replaced. Also, he is ordering new UV Bulbs for the water treatment plant, as budgeted for 2023. Work continues regarding the change out to digital meters; he will be ordering the 50 budgeted meters for 2023 soon. 
  2. Katti Arnold, Town Clerk
    The System Totals Report for July and June were included in the packet for review. The water loss has gone back up to 10.57% in May and 14.37% in June. 
  3. Kimberly Boyd, Town Administrator
    DOLA awarded full grant amount of $1,000,000 requested. Colorado Rural Water Association will be doing our rate study for free and the requested Admin Grant for such from DOLA will be rescinded.

Executive Session

  1. For the Board of Directors for the purpose of receiving legal advice pursuant to Section 24-6-402( 4 )(b ), Colorado Revised Statutes as it relates to operation, water rights, and member terms of KWW A. The board sought legal guidance from their attorney. No votes or decisions were made.

Old Business

  1. Ordinance for water determinations and Bargain and Sale Deed
    Tabled until August. Eric Whitman made the motion to approve to table until August. Teresa Parker seconded, and the motion passed with no discussion.
  2. Clean up Operating Agreement between Town of Kiowa and KWWA
    Tabled until August.
    The board discussed the operating agreement and what needed to be done to get it finished and submitted. It was decided to table additional discussion and a decision until August. Eric Whitman made the motion to table and Teresa Parker seconded. The motion passed with no discussion.
  3. Rate Study and Asset Management
    The rate study is being done by the Colorado Rural Water Association at no charge. Ms. Boyd asked DOLA to rescind the request for an Adm in Grant for the rate study and rewrote the request for an asset management study. We are waiting for a response to that second grant request at this time.

New Business

  1. Hardship Letter's to Board
    Hardship Letter with payment plans. George is creating a resolution on delinquent or past due accounts. Eric Whitman made the motion to approve that George can create a new resolution for past due accounts no longer than 60 days. Teresa Parker seconded, and the motion passed with no discussion.

    In addition, the payment plan must be kept and if they miss a payment their full remaining account balance is due in full, or water shut off. Teresa Parker made the motion to approve the payment plans. Eric Whitman seconded, and the motion passed with no discussion.
