Call to Order
The regular meeting of the Town of Kiowa Planning Commission was called to order at 6:00pm by Chairperson Wendy Frenzel.
Roll Call
Present: Chairperson Wendy Frenzel, Co-Chairperson Todd Lane, Commissioner Julie Mizak, Commissioner Shannon Lane, Commissioner Lori Rafferty, Commissioner Sandy Kalish via Zoom, and Town Trustee Terry Howard via Zoom.
Absent: Mayor Rick Kolm, Mayor Pro Tem Trevor Smith, and Town Trustee Tammy Hart.
There was a quorum to conduct business.

Chairperson Wendy Frenzel entertained a motion to approve the agenda. Commissioner Julie Mizak made a motion to approve the agenda. Co-Commissioner Todd Lane seconded the motion, and the motion passed 5-0 with no discussion.

- Update to Zoning Code
- Marijuana and Natural Medicine Zoning Code. Extensive discussion was held over the differences between medical marijuana and recreational marijuana, to include dispensaries, shops, cultivation (growers), manufacturing operations, and official definitions by the State of Colorado. Additionally, there was discussion about what the definition and role of a medical marijuana caregiver is and the licensing requirements through CDPHE. In addition, the definition of natural medicine by the State of Colorado was requested and it was noted how this might be fluid since it is such a new law, and it deals specifically with Psilocybin found in mushrooms. An ordinance from the Town of Breckenridge was looked at as a reference point to begin with to create one for the Town of Kiowa. It was pointed out that Elbert County does not allow marijuana shops/dispensaries and that it was voted down by the citizens of the Town of Kiowa previously, so it will not be allowed at this time in Kiowa.
- Definitions. Requests were made by the board to get better definitions for the following: ADU, Commercial Greenhouse, Non-Commercial Greenhouse, Riding Academy, Dude Ranch, Sawmill and Water Reservoir.
- Chapter 16 – Changes to Article VI – Section 16.61 – Table of Uses – Residential Districts. It was decided that the board had covered this and approved this section in a previous meeting and did not have to go over it again.
