Special Meeting Minutes
October 1, 2024 – 7pm
Call to Order
The special meeting of the Board of Trustees was called to order on October 1, 2024, at 7:00 PM by Mayor Rick Kolm.
Roll Call
Present: Mayor Kolm, Mayor Pro Tern Smith, Trustee Wineland, Trustee Howard, Trustee Hart, and Trustee Shafer. The Town of Kiowa had a quorum to conduct business.

Agenda Consent
Trustee Howard made the motion to approve the agenda and Trustee Wineland seconded the motion. The motion was carried 6-0 with no discussion.
Public Comment
None.
Trustee Hart made the motion that we revise the agenda to move C. Kiowa Water and Wastewater Authority under New Business and before the Work Session with DOLA so that the applicant does not have to sit through the entire meeting and presentation. Trustee Howard seconded this motion, and the motion carried 6-0 with no further discussion.
New Business
- Kiowa Water and Wastewater Authority
Mr. Gabehart spoke to his education, past involvement with the Town and other public offices and boards he has served on within the Town over the years, and civic activities that make him qualified to serve on the Kiowa Water and Wastewater Authority Board and he fielded a variety of questions by the Board of Trustees.
Mayor Pro Tern Smith made a motion to accept and approve Mr. Gabehart's appointment to the Kiowa Water and Wastewater Authority Board of Directors. Trustee Shafer seconded, and the motion was carried 6-0 with no discussion.

Ms. Davidson gave Mr. Gabehart the oath of office to serve on the KWW A Board of Directors making his appointment effective at the next monthly meeting on October 8, 2024.
WORK SESSION - Main Streets Community-Tracey Stoffel and Gayle Langley, DOLA
Ms. Stoffel and Ms. Langley conducted a Power Point presentation into the Main Streets Community Program with DOLA to the Board of Trustees.
NEW BUSINESS - continued
- RESOLUTION 13, SERIES 2024, A RESOLUTION AUTHORIZING THE TOWN ADMINISTRATOR TO SEEK MAIN STREET COMMUNITY MEMBERSHIP WITH THE DEPARTMENT OF LOCAL AFFAIRS (DOLA)
Trustee Shafer made the motion to approve Resolution 13, Series 2024, and Trustee Wineland seconded his motion. Motion carried 6-0 with no further discussion. - RESOLUTION 14, SERIES 2024, A RESOLUTION APPOINTING MUNICIPAL COURT JUDGE PAUL KING AND HIS TWO-YEAR CONTRACT FOR PROFESSIONAL SERVICES
Ms. Boyd affirmed for Mayor Kolm that while the approval to engage with Judge Paul King was approved by majority vote of the Board earlier in the year, it has been established that there is a requirement of the Kiowa Municipal Code to accept and approve his 2-year term commitment by resolution.
Trustee Shafer made the motion to approve Resolution 14, Series 2024 and Trustee Howard seconded his motion and motion carried 6-0.
DISCUSSION:
Mayor Pro Tem Smith asked Ms. Boyd to clarify the fine schedule in place for the municipal court being established and starting the next day, on October 2nd Ms. Boyd affirmed that Judge King had requested there be no set fine schedule established. He requested we stick to what the Kiowa Municipal Code already has established, which is a maximum fine not to exceed $2650, which gives the judge a range od discretion on fines to be assessed. Trustee Wineland asked if there are people on a docket to even hold court the first day of court. Ms. Boyd affirmed that she has no knowledge of the court dockets because the Town staff is not involved in the court process whatsoever. She further stated that no court documents are kept by the Town but the fact that a court session is still scheduled indicates for her that there must be a docket established. Ms. Boyd further advised a page on the Town's website has been created with all the pertinent information regarding court dates, times, location, court clerk contact, etc.

Trustee Wineland made the motion to adjourn at 7:53pm. Trustee Shafer seconded, and the motion carried 6-0 with no discussion.
The next regular meeting will be on October 8th at Town Hall at 7:00pm.
