November 12, 2024
Call to Order
The regular monthly meeting of the Board of Trustees was called to order on November 12, 2024, at 7:20 PM by Mayor Kolm.
Roll Call
Present: Mayor Kolm, Mayor Pro Tem Smith, Trustee Wineland, Trustee Howard, Trustee Hart, and Trustee Shafer. The Town of Kiowa had a quorum to conduct business.

Mayor Kolm led the Board in the Pledge of Allegiance.
Agenda Consent
Mayor Pro Tem Smith made a motion to approve the agenda and Trustee Wineland seconded the motion. The motion was carried 6-0 with no discussion.
Public Hearings
ORDINANCE 13, SERIES 2024 -AN ORDINANCE APPROVING THE CONVEYANCE OF CERTAIN PROPERTY RIGHTS AND WATER RIGHTS TO DIGBY PROPERTIES LLC
- Mayor Kolm opened the public hearing and there were no public comments. Trustee Howard made the motion to approve and Trustee Wineland seconded the motion. The motion was carried 6-0 with no discussion.
ORDINANCE 14, SERIES 2024-AN ORDINANCE APPROVING THE CONVEYANCE OF CERTAIN PROPERTY RIGHTS AND WATER RIGHTS TO MAYFIELDS
- Mayor Kolm opened the public hearing and there were no public comments. Trustee Howard made the motion to approve and Trustee Wineland seconded the motion. The motion was carried 6-0 with no discussion.

Staff Reports
Mayor
Mayor Kolm expressed his gratitude for the snow plowing job Iconic Excavating did for the Town with the last storm. Mayor Kolm made reference to the pictures Mayor Pro Tem Smith provided from the front of his house and exclaimed that was the best plowing job he has witnessed in years.
Ms. Borne acknowledged Ms. Boyd involvement in assisting Elbert County Emergency Management in coordinating food for those that were stranded in Kiowa during the storm. Ms. Boyd advised Elbert County OEM was not aware of all the resources Kiowa actually had at their disposal. There were 22 people stranded at the fairgrounds for numerous days. Erica Johnson with ECCO and the Kiowa Lions Club ultimately were able to pull people and resources together to make breakfast for the stranded individuals. Bino' s and Leches were working to provide other food but by lunch time the storm started to clear and those stranded were able to get back on the road.
Mayor Kolm expressed the importance of being able to disseminate emergency information over social media and otherwise.

Mayor Kolm asked if she had heard from the cable company. Ms. Borne deferred to Ms. Boyd who advised Special Counsel, Mr. Poppe, and insurance requested she send the Right-of-Way Permit Application to them one more time, but she has not received any response back, to date.
Town Administrator
Ms. Boyd gave updates to the following:
- Tim Craft vs Official Custodian of Records of the ToK and KWW A, Case No. 2024CV30029
- Dismissed on October 31, 2024, with prejudice, meaning it cannot be filed in the same court due to this court making a final determination on the case's legal and factual issues.
- Apple iPads and Apple Business Manager
- Verification is completed with Apple Business Manager, the iPads can be ordered, and expected delivery is Thursday, November 14th. We ordered the keyboards from Amazon for both the Town and KWW A and have them in our possession now.
- Kiowa Bridge and Stormwater Drainage & Sidewalk Project update
- Construction will begin at or around May 2026.
- Total preliminary budget on this project is $12.SM and that will all be state funded
- Will not be raising the height of the bridge
- Will maintain the historical depiction of the concrete railings that it currently has, rather than make them metal.
- Staff is in need of assistance from Trustees to participate with the SherifPs Christmas event on Saturday, December 14tti (4-hour event) working the cake walk.
- Kim and 1 other from 11 am to 1 pm - Trustee Shafer volunteered for this shift.
- Terry and 1 other for 1 pm to 3pm - Trustee Hart volunteered for this shift.
- Wire Nut repairs to outside lighting at Town Hall
- Called them out due to lighting being out on west side of building and east side overhang and front light for flag.
- Found arcing inside the wall at the front of building, "extra" wires that went nowhere and that were arcing, and water in the can lights under the overhang in the front and over on the eastside of building.
- Wiring running from the west side of the building and around to the front was illegal and GFis were found to be blown.
- Replacement fixtures under the overhangs, at the front and west side of building, and new fixtures on the overhang on the east side of building. New GFis were installed everywhere they were showing blown. Wiring was brought up to code on the west side of the building and front.
- Cost was approximately $7500.

Consent Items
Approval of Minutes from October 8, 2024, Monthly Meeting and October 16, 2024, Joint Work Session with Planning Commission
Trustee Howard made the motion to approve the minutes from October 8, 2024, Monthly Meeting and October 16, 2024, Joint Work Session with the Planning Commission. Trustee Wineland seconded the motion, and the motion was carried 6-0 with no discussion.
Expenditures for Year-to-Date 2024
Ms. Boyd advised there were no extraordinary or unusual expenses in the past month, but she did move money from the general checking over to the money market after successfully negotiating a higher interest rate with Farmers State Bank- increasing from 3.5% to 5%. By doing so the interest returned by doing that increased the interest payment back to the Town by a little over $1,000.

Mayor Pro Tem Smith made the motion to adjourn at 8: 17pm. Trustee Wineland seconded, and the motion carried 6-0 with no discussion.
The next regular meeting will be on December 10th at Town Hall at 7 :00 p.m.
