Town of Kiowa Board of Trustees Regular Monthly Meeting Minutes

May 9, 2023

Call to Order

The regular meeting of the Board of Trustees of the Town of Kiowa was called to order on May 9, 2023, at 7:00 PM by Mayor Rick Kolm.

Roll Call

Present: Mayor Rick Kolm, Mayor Pro Tem Trevor Smith, Director Andrew Lowry, Director Josh Baker, Director Terry Howard, Director Baillie Wineland, and Director Jonathon Shafer were present. The Town of Kiowa had a quorum to conduct business.

Ruth Borne, Town Counsel via Zoom.

Agenda Consent

Mayor Pro Tem Smith made the motion to revise the agenda by moving New Business above Executive Session. Director Howard seconded the motion with revisions to the agenda, and the motion was carried 6-0 with no discussion.

Staff Reports

  • Mayor
    None.
  • Board of Trustees 
    Director Howard advised the agenda for this meeting was not available due to an error message advising "Page Not Found." Ms. Boyd advised she would inquire into this error message and get it
    repaired.
  • Town Attorney
    None.
  • Town Administrator
    Ms. Boyd advised on April 21st she submitted a grant application to the CDOT TAP Program for funding assistance with the design and engineering portion of the stormwater drainage and sidewalk project in the town, and she will apply for $500,000 more from DOLA in the next round of submissions in July that will also go toward this portion of the project, for a total cost of $2.5 million going toward the design and engineering, and the remaining cost will be in excess of $13 million. 

    Ms. Boyd advised the Event Planning Committee has been throwing around the idea of doing a concert in the park concept in Kiowa. Looking at having bands on various Saturdays in June, July and August in the evenings, from 5-7:30pm.
  • Public Works
    Ms. Boyd advised we are actively trying to address potholes, but due to the delay in getting the asphalt repair order from Home Depot the potholes are delayed. Further, CDOT has no excess road repair material to spare for us this year. 

    Ms. Boyd advised that the Town is responsible for curb line maintenance and upkeep per Colorado Revised State Statute and street sweeping is therefore our responsibility. Mendez will be getting the street sweeper up and running for the season and at the first available opportunity we will start doing that.
  • Code Enforcement
    2nd quarter report is due in July.

Consent Items

  • Approval of minutes from April 18, 2023, BOT Monthly Meeting 
    Director Howard made the motion to approve the minutes from the April 18, 2023, Monthly Meeting. Director Lowry seconded, and the motion was carried 6-0 with no discussion.
  • Expenditures for Year-to-Date 2023 
    Director Howard made the motion to approve the year-to-date 2023 expenditures. Director Wineland seconded, and the motion was carried 6-0 with no discussion.

Old Business

None.

Executive Session

Director Howard moved to adjourn the open meeting at 7:37pm and move into executive session, seconded by Mayor Pro Tem Smith. Motion carried 6-0 with no discussion.

Director Shafer moved to adjourn the executive session and move back into open meeting at 8:07pm, seconded by Director Howard. Motion carried 6-0 with no discussion.

Director Howard made the motion instructing Ruth Borne to send Notice of Malpractice Claim to former Town legal counsel, Robert Tibbals. Director Shafer seconded, and the motion was carried 6-0 with no discussion.

Mayor Pro Tem Smith made the motion instructing Ruth Borne to send correspondence to Craft Companies and all other necessary parties regarding the balance remaining for chargeback invoicing on legal fees due and owing from the Kiowa Creek Meadows development, further requesting a 15-day response time, and advising the Town's intent on filing a lien if not paid. Director Lowry seconded, and the motion carried 6-0 with no discussion.

New Business

  • Town Clerk, Tasha Chavarria, gave her official resignation to the Board, effective May 31, 2023.
  • Request for Deviation from the Parking Space Requirements as stated in Chapter 16-Zoning, Sec. 16-114 - 304 Comanche Street 

    Mayor Pro Tem Smith made the motion to approve the request for parking deviation on 304 Comanche Street, seconded by Director Baker. Motion carried 6-0 with no discussion.

Adjourn

Director Baker made the motion to adjourn at 8:18 p.m. Director Lowry seconded, and the motion carried 6-0 with no discussion.

The next regular meeting will be on June 13th at Town Hall at 7:00pm
