Call to Order
The regular meeting of the Town of Kiowa Planning Commission was called to order at 6:00pm by Chairperson Wendy Frenzel.
Roll Call
Present: Chairperson Wendy Frenzel, Commissioner Sandy Kalish, Commissioner Lori Rafferty, Commissioner Julie Mizak, Mayor Rick Kolm, and Trustee Terry Howard were present via Zoom at 6:08pm.
Absent: Mayor Pro Tern Trevor Smith, Town Clerk Sasha Davidson, Co-Chairperson Todd Lane, and Commissioner Shannon Lane.
There was a quorum to conduct business.

Consent Items
Commissioner Kalisch made a motion to approve the agenda. Commissioner Mizak seconded the motion, and the motion was carried 4-0 with no discussion.
Commissioner Kalisch made a motion to approve the minutes from the May 1, 2024, Special Meeting. Commissioner Rafferty seconded the motion and the motion carried 4-0 with no discussion.
New Business
- Rezone application by Foster Houts for 811 County Road 134, Kiowa CO, 80117 rezone request from Public Land (PL-1) to Commercial (C-2).
Discussion: Mayor Kolm advised Mr. Houts this property falls under the umbrella of the Town's code enforcement, and he will be required to comply like the rest of the town. Commissioner Mizak inquired as to whether Mr. Houts has registered his business with the Department of Agriculture and as to the name of Mr. Houts' business. Mr. Houts confirmed he had, and the official name of his business is American Custom AG. Mayor Kolm inquired as to whether Mr. Bout's is having all his shipments of piping hauled into Kiowa tested for radioactive material and he confirmed he is. Commissioner Kalisch expressed a desire to not have this property tum into just a used car lot.
Commissioner Mizak made a motion to move the rezoning application for 811 County Road 134, Kiowa, CO forward to the Town of Kiowa Board of Trustees for their review and final approval for this property to be rezoned from Public Lands 1 (PL-1) to Commercial (C-2). Commissioner Kalisch seconded, and the motion carried with no further discussion. - Rezone application - 326 Comanche St., Kiowa, CO 80117
Discussion: Applicant Tara Schleeter advised she was seeking to open a childcare center at this location that would service up to fifty-four families. Ms. Boyd discussed the communications and discussions between herself, SAFEBuilt staff, and town legal as this request relates to this request. Ms. Boyd pointed out that per the currently revised municipal zoning codes this type of proposed business would not be allowed in the Town Center (TC) and an application for rezone or special review would not be entertained, per the Town code. SAFEBuilt staff and legal are in concurrence. Ms. Boyd advised Ms. Schleeter that this type of business would be considered in other areas of town, either by rezone or special review, but it cannot be considered in Town Center (TC).
Commissioner Kalisch made a motion to not move this request for special review application at 326 Comanche Street forward to the Town of Kiowa Board of Trustees for their review and final approval. Commissioner Mizak seconded, and the motion carried with no further discussion.
