Board of Trustees Special Meeting Minutes

January 5, 2023 – 7pm

Call to Order

The special meeting of the Board of Trustees of the Town of Kiowa was called to order on January 5, 2023, at 7:00 PM by Mayor Rick Kolm.

Roll Call

Present: Director-elect Trevor Smith, Director-elect Josh Baker, Director-elect Andrew Lowry, Director-elect Baillie Wineland, Director Terry Howard, Director Jonathon Shafer. The Town of Kiowa had a quorum to conduct business. 

Town Administrator: Kimberly Boyd 
Town Clerk: Tasha Chevarria 
Town Counsel: Ruth Borne Guests: Debbie Ullom, KWWA Tim Craft and Jeff Keeley, Craft Companies Cory Rutz, Attorney at Law Eric Whitman, KWWA Ken Turnbull, property owner

Pledge of Allegiance

Mayor Rick Kolm led the audience in the pledge of allegiance.

Agenda Consent

Director Howard made the motion to approve the agenda. Director Smith seconded, and the motion carried 6-0 with no discussion.

Public Hearing

None.

New Business

1. Oaths of office were administered to incoming Board Trustees: Trevor Smith, Baillie Wineland, Josh Baker, and Andrew Lowry
2. Election of Mayor Pro Tem 
   Director Howard made the motion to nominate Director Smith as Mayor Pro Tem. Director Lowry seconded, and the motion carried 6-0 with no discussion.
3. Work Session on Kiowa Creek Meadows Development 
   Craft Companies, the Developer requested a work session on his project, Kiowa Creek Meadows Development and discussed many business points of the project. 
4. Mayor opened the public hearing for Ordinance 1, Series 2023: An Ordinance rescinding the Kiowa Creek Meadows Development agreement and the vested property rights pursuant to Article 68 of Title 24, C.R.S., as amended. Cory Rutz, Attorney for Kiowa Creek Meadows Development, Tim Craft, Debbie Ullom all made public comments regarding rescinding the development agreement. Director Shaffer made a motion to table the ordinance for Tuesday, February 10, 2023, and schedule a work session with the Kiowa Water and Wastewater Authority on Tuesday, February 7, 2023. Director Wineland seconded, and the motion passed 5-0 with Director Howard being the sole NAY.

Director Smith made the motion to adjourn at 8:48pm. Director Lowry seconded, and the motion carried 6-0 with no discussion.

The next regular meeting will be on January 10th at Town Hall at 7:00pm
