May 13, 2025

Invocation/Pledge of Allegiance

Pastor Kevin Weatherby of Save the Cowboy Ministry gave the invocation, and Mayor Howard led the Board in the Pledge of Allegiance. 

Call to Order/Roll Call

Mayor Howard called the regular monthly meeting of the Board of Trustees to order on May 13, 2025, at 7:04 PM. 

Present: Mayor Howard, Mayor Pro Tern Hart, Trustee Wineland, and Trustee Smith were present. The Town of Kiowa had a quorum to conduct business. 

Trustee Stahl arrived late at 7:18 pm 
Trustee Shafer arrived late at 7:40 pm

Agenda Consent

Trustee Wineland motioned to approve the agenda. Mayor Pro Tern Hart seconded, and the motion was carried 4-0 with no discussion. 

Public Comment

  • Mona Schantz - Owner of High Plains Food at 403 Arapahoe Street and Kiowa resident. Spoke to the proposed ordinance on tonight's agenda.
  • Charles Valenzuela-Resident at 619 CR-145, Kiowa. Spoke to the dog poop stations along CR-45 being out.
  • Scott Stillman - Owner of Prism Builds at 329 Comanche Street, Kiowa. Spoke to the proposed ordinance on tonight's agenda.
  • Joey Kuhn, Owner of Just Peachy Day Spa at 320 Comanche Street, Kiowa. Spoke to the proposed ordinance on tonight's agenda and issues with code enforcement regarding the current sign code.
  • Annette Burmaster- Owner of Patty Ann's Cafe at 230 Comanche Street, Kiowa. Spoke to the proposed ordinance on tonight's agenda.

Mayor Howard opened the public hearing at 7:22 pm. 

Public Hearings

  1. Kiowa Parent Teacher Community Club
    JR Prokop spoke to this event and advised that they would not be doing anything different this year than they had in the past. All servers will be TIPS certified, the Sheriffs Office is assisting with security again this year, and wristbands will be utilized. 

    No public comment was given. Trustee Smith moved to approve the special event liquor permit for this event, and Trustee Wineland seconded it. The motion passed 5-0 with no further discussion. 
  2. ORDINANCE 3, SERIES 2025, AN ORDINANCE OF THE TOWN OF KIOWA, COLORADO, AMENDING THE TOWN OF KIOWA ZONING CODE, CHAPTER 16, ARTICLE XIV - SIGN CODE, TOWN OF KIOWA, COLORADO

    ** Trustee Shafer arrived late at 7:40 pm ** 

    Ms. Boyd advised that the proposed revisions made to the sign code included language permitting certain types of flags, banners, and temporary signs that were not previously allowed in the Town Code, along with the process of obtaining them and the stipulations for each type (length allowed, etc.). 
    Trustee Stahl moved to table approval of this ordinance until a work session coordinated with the Planning Commission can discuss further context and revisions, and Trustee Wineland seconded it. The motion passed 6-0 with no further discussion. 

    Trustee Smith motioned to halt all code enforcement activity regarding sign code violations until this ordinance can be worked through with the Planning Commission, and Trustee Wineland seconded. The motion passed 6-0 with no further discussion. 
  3. Board Endorsement for Kim Boyd's application to the Colorado Municipal League's (CML) Executive Board

    Trustee Shafer motioned to approve the Board's endorsement of Kim Boyd's application to the Colorado Municipal League's (CML) Executive Board, and Trustee Stahl seconded. The motion passed 6-0 with no further discussion. 

Staff Reports

  1. Mayor
    None.
  2. Board of Trustees
    Mayor Pro Tern Hart mentioned her conversations with Senior Center representatives concerning building issues. They are trying to raise money to make necessary repairs through an upcoming craft show, and a quilt raffle.
  3. Town Attorney
    Ms. Boyd read into the record the monthly status report memo addressed to the board from Town General Counsel.
  4. Town Administrator
    • CivicPlus Agenda and Meetings software update
      Staff have been participating in a series of training sessions and meetings to set up the templates of each board and commission and receive training on setting those up with approvals, etc., once they go live. We anticipate going live with this software in July.
    • Town Audit
      The 2024 audit is in its final draft phase and going through the last internal processes before it reaches its final format. We will have it available for review before next month's meeting, and I will invite Eric Miller from the Adams Group to present the final audit to you at the June meeting.
    • Xcel Energy Pathways
      Referral Application Review for Kiowa-CORE Engineering completed the application review referral for the Town on this project, and the only comment they could provide was:

      "It appears the lines will be anywhere from 1,500 to 2,000 feet to the east of the current developed area. Should Kiowa want to expand eastward, development should maintain a setback of 300 feet from the lines. Other than that, we see no direct impact on the Town or Town facilities. "
    • Town Parks Project
      The concept paper is due to GOCO on July 24th, and we will know by August 8th if we are invited to apply. If invited this cycle, the application is due by September 11th, and awards are expected by December 12th, with contracting completed after the New Year. The project can begin as soon as the contract is completed.

      If we are not invited to this cycle, the second cycle concept paper is due on January 15, 2026, and we will know by January 30, 2026, if we are invited to apply for that cycle. If invited to the second cycle, the application will be due on March 5 and awards will be made in June 2026.

      We will create a committee for this improvement project consisting of 5-6 people. This committee will steer the project's engagement and awareness, fundraising efforts, and partnerships. It will also review the project design before going to a community meeting with the public. 

      Fundraising Efforts 
      Penny Wars at Kiowa School - The winning classroom was Ms. Waters's 1st grade class, which scored over 10,000 points! They raised a total of $100.69, so a check will go back to Ms. Waters for her classroom needs and wants. The kids will receive a pizza party hosted by the Town on Thursday, May 14th. 

      Kiowa Lions Club-At their last scheduled pancake breakfast of the year, the Kiowa Lions Club brought in $667 in tips, which we gave them back along with 
      $607 in food costs, for a total of $1274. Those funds will help them with much­needed building repairs. 

      We will also hold our annual Father's Day Pancake Breakfast on Saturday, June 14th, with the Lions Club, and we will do this again for the Parks Project! 

      Bino's at the Easter Egg Hunt - The tip jar at this event raised $43. We will donate that back to Kiowa HS Boys Basketball and sponsor their annual fundraiser on June 14th. The money will help those kids attend camps and training this summer. 
    • Nordman Park Internet and Security Cameras
      Comcast Business will be pulling intemet/Wi-Fi to the park next week. This will allow the Wi-Fi needed for permanent security cameras and the public when visiting our town park for events. We will upgrade our plan with them, and the cost of providing this monthly Wi-Fi is $300 for download speeds of 800 Mbps.
    • CDOT/Mill and Fill Project
      At the monthly project management meeting with Kimley-Hom and CDOT, CDOT generously decided to transfer funds held by them for the final stage of the SH-86 Improvements, which are the mill and fill, to the Town before the end of this project. The Town would hold those funds to be used in the construction phase.
    • SH-86 Sidewalk and Storm Drainage Project
      Kimley Hom expects to have this project at 60% by mid-August and ready for FIR
      (Field Inspection Review) to the Town and CDOT (which will take approximately 3 weeks for CDOT to complete their internal review). They expect it to be at 90%somewhere between mid-September and the end of November. The next Community Meeting with Kimley Hom on this project is scheduled for Thursday, June 19th, at 6 p.m., at the Fairgrounds again.
    • Upcoming Town Events: First Music in the Park happens on Saturday, May 24th. This year, we moved the times for this event, from 4 pm to 6:30 pm, and back to Nordman Park. Our first featured band is These Guys, and the social media posts are garnering much interest for this first event.
    • SIPA grant for digitizing Town files
      We will be applying for a grant that will allow us to digitize all our town records and files requiring historical record preservation. This will be a $10,000 ask on this grant application.
    • Town Hall building improvements
      Through meetings with the Colorado Energy Office reps, we learned of a program called Energy Performance Contracting. The process involves the EPC audit our facilities, which are conducted by pre-qualified companies that serve as industry experts. The audit will determine items such as facility improvement measures
      (such as replacing windows, siding, roof, etc.), utility and operational savings, eligible grants, etc. So, these audits can identify numerous projects, not just one. The benefits are immediate, and we will realize them through our energy cost savings. Hence, while this is documented as a loan on costs, the payback is through the continued payment of our energy bills with Black Hills and CORE. lfwe do not realize these savings through our monthly energy billing, the EPC will write off the costs.
  5. Public Works
    Sidewalk Repairs in front of HOO Motors-Iconic Contracting made some emergency sidewalk repairs in front of Hoo Motors last month. The sidewalk had deteriorated, making it extremely unsafe and liable. The repairs cost $6600. 
  6. Code Enforcement-2nd quarter report due in July 2025

Consent Items

  1. Trustee Smith motioned to approve the minutes of the April 8, 2025, monthly meeting. Trustee Wineland seconded, and the motion was carried 6-0 with no discussion.
  2. Ms. Boyd noted the following in this month's YTD expenditure report:
    7043-Kimley Hom- $280,713 spent to date, and all ARP A funds totaling $191,277.16 being reserved for this project have been expended. 

    4400 - KWW A Operating Contract - with the finalization of the amended Operating Agreement, the payments have increased monthly from $5500 to $7,052.49/month. This figure is based on the detailed expenses shared during the workshop with the Authority. Based on that detail, the total shared expenditures were $78,419.90 for 2025. They have paid $22,000 to date, which was deducted from the 2025 figure, leaving $56,419.90 left to be paid out through 2025. That is split to $7052.49/month from May until December. 

    6512- CIRSA (WC)- a negative in this line item due to the refund we received from 2024 premiums. Based on the data submitted in the required annual reports, CIRSA realized we had been overpaid based on that data. 

    6800 - General Office Expenses - due to the board room furniture purchased at the beginning of the year, totaling $7,365. 

    6822-Supplies for Events/Specialty-This is a very large amount due to the $15,000 payment already made toward the fireworks events.
     
    8000-Interest Income-Increasing the amount we hold in our Money Market account netted us approximately $8700 of increased income just in the first quarter of 2025. 

    Trustee Wineland motioned to approve the Year-to-Date expenditures. Trustee Smith seconded, and the motion was carried 6-0 with no discussion.
