Town of Kiowa Board of Trustees Regular Monthly Meeting Minutes

February 14, 2023 - 7pm

Call to Order

The regular meeting of the Board of Trustees of the Town of Kiowa was called to order on February 14, 2023, at 7:02 PM by Mayor Kolm.

Roll Call

Present: Mayor Kolm, Director Trevor Smith, Director Andrew Lowry, and Director Josh Baker were present. Director Terry Howard and Director Baillie Wineland were present on Zoom. Director Jonathon Shafer arrived late at 7:12 pm. The Town of Kiowa had a quorum to conduct business. 

Also present were Town Administrator, Kimberly Boyd, Town Clerk, Tasha Chevarria and Town Counsel, Ruth Borne.

Agenda Consent

Ms. Boyd advised there was revisions to the agenda that included: Amend Agenda under New Business - additional policy to adopt Item E, New Business and Item F, Preliminary Financial Presentation on Kiowa Creek Meadows by Craft Companies. Further noting that "Old Business" is also a continuance of a Public Hearing.

Mayor Pro Tem Smith made the motion to approve the agenda. Director Lowry seconded, and the motion carried 5-0 with no discussion.

Staff Reports

  1. Mayor
    None.
  2. Board of Trustees
    None.
  3. Town Attorney
    Ms. Borne advised she had received an objection from Kiowa Creek Meadows developer pertaining to the Chargeback Agreement and hopes to resolve that without much further discussion.
  4. Town Administrator
    Ms. Boyd advised we are still in the process of completing the energy audit with the State Energy Office as it pertains to the Town. The Town did receive the requested impact grant from DQLA to complete an update to the Town's much outdated comprehensive plan and municipal code. An RFP will be going out in the upcoming weeks to seek a qualified company to complete the updates to the comprehensive plan.

    Ms. Boyd advised the transmission on the Town backhoe has gone out and the equipment is no longer operational.
  5. Public Works 
    None.
  6. Code Enforcement
    First quarter report due in April.

Consent Items

  1. Approval of minutes from January 2023 BOT monthly Meeting, February 6, 2023, Executive Session, and February 7, 2023, Work Session
    Director Baker made the motion to approve the minutes from the January 2023 BOT monthly. Meeting, the February 6; 2023 Executive Session, and the February 7, 2023, Work Session. Director Lowry seconded, and the motion carried 5-0 with no discussion.
  2. Expenditures for Year-to-Date 2023
    Mayor Pro Tem Smith made the motion to approve the expenditures. Director Lowry seconded, and the motion carried 5-0 with no discussion.

Public Hearing

Mayor Pro Tem Smith moved to adjourn the open meeting at 7:12pm and move into public hearing, seconded by Director Lowry. Motion carried 6-0 with no discussion.

    • Big Time Bucking Horse Futurity- September 8-9, 2023
  • Mayor Pro Tem Smith excused himself from this vote due to conflict of interest.
    • Lincoln Day Dinner - May 6, 2023

Dan Guthrie, Event Coordinator, spoke on behalf of the Elbert County Republican Party to these events. He advised they will be checking IDs, utilizing hand stamps/wrist bands to identify those that are of age to drink, and requiring bartenders to be TIPS trained.

Director Shafer moved to adjourn the public hearing at 7:17pm and move back into open meeting, seconded by Mayor Pro Tem Smith. Motion carried 6-0 with no discussion.

Director Baker moved to approve the special event liquor licenses for the Elbert County Republican Party events, seconded by Director Lowry. Motion carried 5-0 with no discussion.

    Director Howard made the motion to approve Policy 22-040: Employment - Recruitment and Selection, Policy 22-041: Employment - Standards of Conduct, Policy 22-042: Employment - Employment, Policy 22-043: Employment - Employment Changes, Policy 22-044: Employment - Discipline, Policy 22-045: Employment -Appeal Procedure, Policy 22-046: Employment - Peer Review Operating Guidelines, Policy 22-047: Employment- Separation, Policy 22-048: Employment- Pre-Termination Meeting, and Policy 22-049: Employment- Personnel Records. Director Lowry seconded, and the motion carried 6-0 with no discussion.
  11. Tim Craft gave a preliminary financial presentation on the Kiowa Creek Meadows development.

Old Business

Director Shafer made the motion for continuance of public hearing on Ordinance 1, Series 2023: An Ordinance rescinding the Kiowa Creek Meadows Development Agreement and the vested property rights pursuant to Article 68 of Title 24, C.R.S., as amended and Chapter 16, Article XII of the Kiowa Municipal Code, as amended. Director Baker seconded the motion, and the motion carried 6-0 with no discussion.

Public Comment

Danielle Ullom of Kiowa Schools, Kristin Decker of Foster Graham, et al, Attorney at Law, and John Hill of the Ranchland News, made comments pertaining to the Kiowa Creek Development and the Development Agreement currently before the town board of trustees.

Director Baker made the motion to adjourn at 8:21pm. Director Lowry seconded, and the motion carried 6-0 with no discussion.
