Call to Order
The regular monthly meeting of the Board of Trustees was called to order on February 13, 2024, at 7:01 PM by Mayor Rick Kolm.
Roll Call
Present: Mayor Rick Kolm, Mayor Pro Tem Trevor Smith, Trustee Baillie Wineland, Trustee Terry Howard, Trustee Joash Baker, Trustee Tammy Hart, and Jonathon Shafer arrived late at 7:09. The Town of Kiowa had a quorum to conduct business.

Agenda Consent
Mayor Pro Tem Smith made the motion to approve the agenda. Trustee Howard seconded the motion and the motion was carried 6-0 with no discussion.

Mayor Pro Tem Smith reported that he recently became aware of an agreement between the Town of Alt and the Town of Nunn for shared law enforcement services and wondered if that is something we could investigate with the Town of Elizabeth. - Town Attorney

- 2/27/23 - next and final Open House 5:30p-Elbert County Fairgrounds
- 2/29/23 - Virtual Presentation at 6pm via Zoom. This will be more of a presentation rather than an open house seeking feedback from the community.
- Kimley-Hom anticipates having a draft to Town staff on or about March 18, 2024.
- Municipal Court-a court clerk and judge have been engaged but we are still seeking a prosecutor. There are a lot of items that need to be put into place prior to court commencing - violation books, code reviews, etc. The original intention was to start in March but will more than likely be later than that.

Consent Items
- Approval of minutes from December 12, 2023, BoT Monthly Meeting
Mayor Pro Tem Smith made the motion to approve the minutes from the January 9, 2024, BoT Monthly Meeting. Trustee Wineland seconded, and the motion was carried 6-0 with no discussion. - Expenditures for Year-to-Date 2024
Mayor Pro Tem Smith made the motion to approve the YTD 2024 financials. Truste Howard seconded, and the motion was carried 6-0 with no discussion.
Public Hearing
Trustee Shafer made a motion to go into public hearing at 7:22pm, Trustee Baker seconded, and the motion carried 6-0 with no discussion.
- Jill Walkinshaw of Jill's Feed Store in Elizabeth spoke to the fundraising dinner and silent/live auction event she planned at the fairgrounds on February 24, 2024. She advised it was to benefit the father of one of her employees who had experienced a traumatic medical emergency leaving him with mobility limitations. This event is to raise funds to renovate his bathroom and install wheelchair ramps at his home. They will be utilizing wristbands to identify underage patrons.
- Danielle Ullom of Kiowa School spoke to the two events planned at the fairgrounds: Casino Night on March 23, 2024, and a Horseshoe Tournament on July 20, 2024. Proceeds from each event will go back toward specific groups of the school. Ms. Ullom advised JR Prokop, Boys Basketball Head Coach, is TIPS certified and will be serving the alcohol and she sill be working the cashier box. Only those of legal drinking age will be permitted entrance to the March 23rd event and wristbands will be utilized at the horseshow tournament to identify underage patrons.
Trustee Howard made a motion to leave public hearing at 7:30pm. Trustee Shafer seconded, and the motion carried 6-0 with no discussion.
Mayor Pro Tem Smith made the motion to approve all three special event liquor license requests. Trustee Howard seconded, and the motion carried 6-0 with no discussion.

New Business
- Town Clerk Sasha Davidson administered the oath of office to newly appointed Board Trustee Tammy Hart.
- PUBLIC HEARING: ORDINANCE 1, SERIES 2024: AN ORDINANCE OF THE TOWN OF KIOWA ESTABLISHING A MUNICIPAL CODE AMENDMENT FOR MUNICIPAL CAMPAIGN FINANCE COMPLAINTS
Public hearing was opened for public comment. No public comment was made.
Mayor Pro Tem made motion for approval and Trustee Shafer seconded this motion and the motion carried 6-0 with no public comment or discussion. - 22-056: Standards of Conduct - BoT Code of Ethics. Mayor Pro Tem Smith made the motion to approve the Standard of Conduct as a policy. Trustee Shafer seconded this motion and the motion carried 6-0 with no discussion.
Old Business
Trustee Howard asked that the Board continue the previous conversation from January's meeting concerning the purchase of new town equipment. Ms. Boyd advised the sand box was transferred from the current plow truck to the dump truck and the plow blade can be removed from this truck to allow its usage without snowplow equipment attachments. Mayor Kolm advised he will go back to Kubota and visit them concerning lease vs. buy, service contracts, and government pricing and contracting.
Trustee Howard made the motion to direct Ms. Boyd to place the current light duty shop truck up for auction sale. Trustee Baker seconded and the motion carried 6-0 with no discussion.
Discussion/Communication
Trustee Howard opened a discussion concerning Board Member, Tim Craft's continued position on the Kiowa Water and Wastewater Authority Board (KWWA). Trustee Howard referred to the previous KWW A monthly board meeting this evening wherein Ms. Boyd reported it had come to her attention that the KWW A had failed to comply with the conflict of interest filings with the Colorado Secretary of State for Tim Craft for 27 filings. All other KWWA Board Member's conflict interest forms are filed.
Attorney Borne reminded the Board that Craft's Designation of Representative Form was submitted incorrectly, making his appointment to the KWW A null and void. This matter was presented previously and with the new KWW A Board important for the Town to review these matters.
At the Board's request an executive session will be scheduled for March 5, 2024, to discuss this matter in more detail.

Trustee Howard made the motion to adjourn at 8:29 pm. Trustee Shafer seconded, and the motion carried 6-0 with no discussion.
The next regular meeting will be on March 12th at Town Hall at 7:00 p.m.
