Call to Order
The regular meeting of the Joint Planning and Variance Commission of the Town of Kiowa was called to order at 6:00pm by Chairperson Wendy Frenzel
Roll Call
Present: Co-Chairperson Todd Lane, Commissioner Sandy Kalish, Member Shannon Lane, Member Lori Rafferty, and Town Board Member Terry Howard. Member Julie Mizak joined the meeting at 6:02pm.
Absent: Mayor Rick Kolm and Mayor Pro Tern Trevor Smith.
There was a quorum to conduct business.

- Approval of agenda
Chairperson Wendy Frenzel requested a motion for approval of the agenda. Sandy Kalich made the motion, Todd Lane seconded, and the motion carried with no discussion. - Approval of minutes from December 13, 2023, meeting
Sandy Kalish made the motion to approve the minutes from the December 13, 2023, meeting. Julie Mizak seconded, and the motion carried with no discussion.
New Business
- Development Impact Fees-Talked to Elizabeth's Administrator about copying their development impact fees. They had a study prepared by BBC based on 2023 dollars. Copying of their ordinance was covered also, which is almost identical to theirs. The fee schedule will not be in the ordinance, but instead will be in a resolution, so it can be updated as needed. The previous numbers were from 2004 and we will be updating to 2024 numbers. Need to look at non-residential/commercial impact fees which were not included in the previous fee schedule. There was also a brief discussion about • law enforcement and the • IGA funds paying for 911 • and the Elbert County Sheriff's Offices' services.
- Administration -Discussion revolved around the role of the Planning Commission. Ruth cleaned up and streamlined the wording. There was talk about the minimum members on the board being five, with three making a quorum. It was noted that the Planning Commission is a volunteer board membership. Using the paper of record for circulation was discussed. The TOK board decided that they would post notices online and on the notice board out front and in the post office if possible. The planning commission wanted to be consistent with this. The planning commission can authorize variances and the board of trustees establishes fees. The topic of having the language about lien language in multiple sections was agreed upon.
- Enforcement -The administrator, code enforcement officer or another designated person have the authority to enforce the zoning code, including issuing written orders and notices of violations. There can be lawsuits and liens used to enforce zoning and building codes. Permits can be denied, withheld, or revoked. Stop work orders can be given by the building official. There is a five-member board of adjustment that comes from the Planning Commission and/or other board members if needed for appeals. If the person requesting the appeal does not like the outcome, they can still appeal to the district court. There was discussion of notices being posted online on the Town's website, on the town's board and if time permits, in the post office, instead of in the newspaper. Uniformed signs for posting were discussed - an example was shown to the commission and approved as the one we will keep using so it is visible and legible.
