December 12, 2023 Board of Trustees Minutes

Call to Order

The regular monthly meeting of the Board of Trustees was called to order on December 12, 2023, at 7:01 PM by Mayor Rick Kolm. 

Roll Call

Present: Mayor Rick Kolm, Mayor Pro Tem Trevor Smith, Director Josh Baker, Director Baillie Wineland, Director Terry Howard, Director Jonathon Shafer were present. The Town of Kiowa had a quorum to conduct business.

Pledge of Allegiance

Mayor Kolm led the Board in the pledge of allegiance. 

Agenda Consent

Director Howard made the motion to approve the agenda, Director Baker seconded the motion and the motion was carried 5-0 with no discussion. 

Staff Reports

  1. Mayor
    Mayor Kolm gave his appreciation to those that coordinated and organized this year's Kiowa Tree Lighting and Lighted Car Parade. He also impressed on the Board the importance in their participation and presence in these events. He also advised Director Andrew Lowry had tendered his resignation from the Board on Monday, effective immediately.
  2. Board of Trustees
    Director Howard echoed Mayor Kolm in impressing on the Board the importance of having their help and participation in Town activities and events as Board members.
  3. Town Attorney
    Ruth Borne advised the lien was filed and recorded on Monday, December 11th, with the Clerk and Recorder's Office. Digby's certified mail came back unclaimed but there is a presumption of acceptance with the one that went out via regular mail. 
  4. Town Administrator
    None.
  5. Public Works
    Ms. Boyd advised the blade sold at auction in September was never picked up by the buyer and has been declared abandoned with the auction company. The Town will retain the monies from the buyer, as per the auction buyer agreement, and the blade will go back up for auction on January 9th.
  6. Code Enforcement
    4th Quarter Report was reviewed by the BoT ..

Consent Items

  1. Approval of minutes from November 14, 2023, BoT Monthly Meeting and November 27, 2023, Special Meeting
    Director Howard made the mot'ion to approve the minutes from the November 14, 2023, BoT Monthly Meeting and the November 27, 2023, Special Meeting. Director Baker seconded, and the motion was carried 5-0 with no discussion.
  2. Expenditures for Year-to-Date 2023
    Mayor Pro Tem Smith made the motion to approve the YTD 2023 financials. Director Howard seconded, and the motion was carried 5-0 with no discussion.

Public Hearing

Director Howard made a motion to go out of open meeting and into public hearing at 7:08pm, Director Wineland seconded, and the motion carried 5-0 with no discussion.

Director Shafer made a motion to go into open meeting at 7:15pm, Director Baker seconded, and the motion carried 5-0 with no discussion. 

  1. Mayor Pro Tem Smith made a motion to approve ORDINANCE 6, SERIES 2023, AN AMENDED EMERGENCY ORDINANCE OF THE TOWN OF KIOWA, COLORADO ESTABLISHING A TEMPORARY MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS FOR SUBDIVISIONS, REPLATS, PLAT AMENDMENTS,MULTI­SITE DEVELOPMENTS, PLANNED UNIT DEVELOPMENTS, REZONING APPLICATIONS; AND DECLARING AN EMERGENCY, Director Howard seconded, and the motion carried 5-0 with no discussion and no public comment. 
  2. Mayor Pro Tem made a motion to ORDINANCE 7, SERIES 2023, AN ORDINANCE
    APPROVING REZONING OF 515 COMANCHE STREET AND AMENDING THE TOWN ZONING MAP FROM PL-1 - SCHOOLS AND PUBLIC LANDS TO MU - MIXED USE RETAIL DISTRICT, Director Baker seconded, and the motion carried 5-0 with no discussion and no public comment.

New Business

  1. Director Wineland made . the motion to approve RESOLUTION NO. 8, SERIES 2023,
    RESOLUTION TO APPROVE 2023 RE-CERTIFICATION_OF VALUES, Director Howard seconded, and the motion was carried 5-0 with no discussion.

None.

Director Baker inade the motion to adjourn at 7:39pm. Director Wineland seconded, and the motion carried 5-0 with no discussion. 

The next regular meeting will be on January 9th at Town Hall at 7:00 p.m.
