August 8, 2023 Board of Trustees Minutes

Call to Order

The regular meeting of the Board of Trustees of the Town of Kiowa was called to order on August 8, 2023, at 7:00 PM by Mayor Rick Kolm. 

Roll Call

Present: Mayor Rick Kolm, Mayor Pro Tem Trevor Smith, Josh Baker, Director Wineland, Director Shafer and Director Terry Howard were present. The Town of Kiowa had a quorum to conduct business. 

Director Andrew Lowry arrived late at 7:03pm.

Pledge of Allegiance

Mayor Kolm led the Board in the pledge of allegiance. 

Agenda Consent

Director Howard made the motion to approve the agenda, Director Shafer seconded the motion and the motion was carried 6-0 with no discussion. 

Staff Reports

  1. Mayor
    Advised he and the town administrator would be meeting with CDOT officials in Kiowa on August 29th regarding the bridge. Suggested creating a bridge committee, but no further discussion was made.
  2. Board of Trustees
    Director Baker provided the board members with hard copies of equipment specifications and quotes from Wagner Equipment (CAT) and Potestio Brothers (John Deere). There was discussion concerning what the Town needed regarding equipment and what each company had to offer in that regard. Director Shafer advised he would reach out to Bobcat for the same. No business was conducted nor decisions made concerning equipment at this meeting.
  3. Town Attorney
    None.
  4. Town Administrator
    Ms. Boyd advised the demo and asbestos mitigation was completed in the basement and claim disbursement was made. Further, the insurance adjuster advised there was more to be recovered in depreciation if the town was to complete the specific scope of work and incur the full cost of that scope of work. There was discussion concerning the requirement to spend more money to get more money from the claim and they did not equate favorably financially or regarding time and labor.
  5. Public Works
    None.
  6. Code Enforcement
    None. Third quarter report due in October.

Consent Items

  1. Approval of minutes from July 11, 2023, BoT Monthly Meeting and July 26, 2023, Special Meeting
    Director Howard made the motion to approve the minutes from both the July 11, 2023, BoT Monthly Meeting and the July 26, 2023, Special Meeting. Director Shafer seconded, and the motion was carried 6-0 with no discussion.
  2. Expenditures for Year-to-Date 2023
    Ms. Boyd advised that due to issues with the A/P software reports were not able to be created this month. Financial reports were tabled until the September meeting.

Public Hearing

Director Howard made a motion to open the public hearing at 7:24pm, Director Baker seconded, and the motion carried 6-0 with no discussion. 

  1. Ordinance 4, Series 2023: An ordinance approving the conveyance of certain property rights and water rights to the Kiowa Water and Wastewater Authority
  2. Ordinance 5, Series 2023: An ordinance approving rezoning of 434 Comanche Street and amending the town zoning map from R-1 Residential to C-1 Retail Business District.

Director Howard made a motion to go back out of the public hearing and into open meeting at 7:37pm, Director Wineland seconded and the motion carried 5-0 with no discussion. Director Shafer had left the room during this motion and subsequent vote. 

Director Howard made the motion to approve Ordinance 4, Series 2023: An ordinance approving the conveyance of certain property rights and water rights to the Kiowa Water and Wastewater Authority, Director Shafer seconded and the motion was carried 5-0 with no discussion and Mayor Pro Tem Smith being the sole nay

Director Howard made the motion to approve Ordinance 5, Series 2023: An ordinance approving rezoning of 434 Comanche Street and amending the town zoning map from R-1 Residential to C-1 Retail Business District, Mayor Pro Tem Smith seconded and the motion was carried 6-0 with no discussion.

New Business

  1. Resolution 5, Series 2023: A resolution declaring property surplus for sale or disposal

Ms. Boyd advised that after the resolution was drafted it was discovered there was a cabinet with multiple boxes of ammunition contained in it in a closet in the office, which was clearly left over property from the Kiowa Police Department. There was discussion pertaining to adding it to the list of surplus items on this resolution. Mayor Pro Tem Smith suggested the ammunition be donated to the Elbert County Sheriff's Office. 

Director Howard made the motion to approve adding the ammunition to the list of surplus property in this resolution, Director Lowry seconded and the motion was carried 6-0 with no further discussion. 

Mayor Pro Tem Smith made the motion to approve the gifting of the ammunition to the Elbert County Sheriff's Office, Director Wineland seconded and the motion carried 5-0 with no further discussion. Director Howard was the sole NAY because she felt it could have been sold and money used by the Town on necessary expenses. 

Mayor Pro Tem Smith made the motion to approve Resolution 5, Series 2023: A resolution declaring property surplus for sale or disposal with the revision of adding the ammunition, Director Baker seconded and the motion carried 6-0 with no discussion.

Adjourn 

Director Howard made the motion to adjourn at 7:55 p.m. Director Wineland seconded and the motion carried 6-0 with no discussion. 

The next regular meeting will be on September 12th at Town Hall at 7:00 p.m.
